Three rules that decide most Montana malpractice claims
The filing deadline
A malpractice claim must be brought within two years of the injury or of the date you discovered it, and never more than five years after. For a child injured before age four, the clock starts at the child’s eighth birthday.

The panel comes first
Montana makes you take a malpractice claim to the Medical Legal Panel before you may file it in court. Even a unanimous finding in your favor does not bind the insurer, who will often still refuse to settle.

What a jury may award
Montana caps what a jury may award for pain and suffering. That cap rose to $350,000 in January 2026 and is scheduled to reach $500,000 by 2029. Your medical bills and lost wages are not capped.
